1. Voluntary recreational participation
I voluntarily request to register for, be rostered in, attend, practice for, volunteer with, or participate in the AlphaOpen recreational tennis league and its related matches, practices, playoffs, meetings, social events, communications, and activities (collectively, the “Activities”). I understand that AlphaOpen is organized and administered primarily by unpaid volunteers. Players also participate voluntarily. AlphaOpen does not employ, train, supervise, certify, or warrant the skill, fitness, conduct, or safety of players, captains, officials, volunteers, spectators, or facility personnel.
Participation is a privilege, not a right. AlphaOpen may establish eligibility requirements, make scheduling and ranking decisions, enforce league rules, discipline conduct, suspend or remove a participant, cancel or relocate an Activity, or modify a season when reasonably necessary.
2. Eligibility, health, and personal responsibility
I represent that I am at least 18 years old and legally able to enter this Agreement. AlphaOpen does not currently accept minor participants. I am physically and medically able to participate safely, or I have consulted an appropriate medical professional before participating.
- I will not participate while impaired or when illness, injury, weather, court conditions, equipment, or another circumstance makes participation unsafe.
- I am responsible for my health decisions, hydration, medication, protective equipment, transportation, personal property, and medical costs.
- I am responsible for obtaining any health, accident, disability, automobile, renter’s, homeowner’s, or other insurance I believe is appropriate. AlphaOpen does not promise or provide insurance covering my injury, property, vehicle, equipment, or liability to others.
- I will inspect the court and surrounding area, use suitable equipment, follow facility rules and reasonable safety instructions, and promptly report hazards and injuries.
- I will follow AlphaOpen’s rules and standards of sportsmanship and will not engage in violence, harassment, discrimination, threats, or intentionally unsafe conduct.
AlphaOpen does not provide medical advice, medical screening, personal coaching, transportation, security, or continuous supervision.
3. Acknowledgment and assumption of risks
I understand that tennis and related Activities involve known and unknown risks that cannot be eliminated. These include slips, trips, falls, collisions, sudden stops and changes of direction; being struck by a ball, racket, net equipment, person, or object; sprains, strains, fractures, cuts, eye injuries, concussion, cardiac events, serious injury, disability, or death; overexertion, dehydration, heat illness, cold exposure, lightning, severe weather, poor air quality, sun exposure, insects, and animals; hazardous courts and surrounding areas; defective or unsuitable equipment; theft, loss, or damage to vehicles, rackets, phones, bags, clothing, and other property; conduct, mistakes, negligence, intentional or criminal acts, or rule violations by other persons; carpools and other travel; and exposure to communicable illness.
I understand that risks may arise before, during, or after play and from scheduling, ratings, rankings, roster and lineup decisions, communications, event changes or cancellations, facility selection, volunteer supervision, emergency response, or the acts or omissions of players, spectators, facility personnel, and other third parties.
I knowingly and voluntarily accept and assume all inherent and other risks of the Activities, whether described above or not, including risks arising from the ordinary negligence of a Released Party, to the fullest extent permitted by applicable law.
4. Release and waiver of liability
In consideration for being allowed to participate, I, for myself and for my heirs, estate, personal representatives, guardians, successors, and assigns, release and forever discharge AlphaOpen.org and the unincorporated AlphaOpen recreational tennis association; its current and former Executive Committee members, officers, captains, coordinators, administrators, neutral approvers, scorekeepers, officials, agents, and other volunteers; other participating players and teams; and, as intended third-party beneficiaries, owners, operators, managers, sponsors, and licensors of facilities used for an Activity (collectively, the “Released Parties”).
This release applies to all claims, demands, causes of action, damages, losses, costs, or expenses arising out of or relating to an Activity, whether caused by an act, omission, decision, condition, or occurrence, including claims concerning scheduling, team formation, rankings, rosters, lineups, rules enforcement, facility or court conditions, equipment, weather decisions, communications, supervision, first-aid or emergency decisions, transportation arranged informally among participants, and the ordinary negligence of a Released Party, to the fullest extent permitted by law.
The Released Parties are not insurers or guarantors of any participant’s safety or property. I remain responsible for safeguarding my vehicle, equipment, valuables, and other belongings and for any injury or property damage I cause to another person.
This Agreement does not release liability that applicable law does not permit to be released, including liability finally determined to result from gross negligence, reckless or willful misconduct, or intentional harm.
5. Covenant not to sue and indemnity
To the fullest extent permitted by law, I agree not to bring or maintain a claim covered by the release above. I will indemnify and hold the Released Parties harmless from third-party claims, losses, or reasonable costs, including reasonable attorneys’ fees, caused by my intentional misconduct, violation of league or facility rules, or negligent acts or omissions. This indemnity does not apply to a Released Party’s gross negligence, reckless or willful misconduct, intentional harm, or liability that cannot lawfully be shifted.
6. Medical emergencies
If I appear to need urgent care and I am unable to act, I authorize AlphaOpen volunteers to contact emergency services and share reasonably necessary identification, emergency-contact, and health information with responders. Volunteers are not required to provide first aid, transportation, or medical care and may not be medically trained. I am responsible for all resulting expenses. This authorization does not create a duty for AlphaOpen or any volunteer to diagnose, treat, supervise, or guarantee my safety.
7. League records and public results
I understand that AlphaOpen may record and publish information reasonably necessary to operate and document a recreational sports league, including my name, player identifier, team, captain or volunteer role, rank, lineup, schedule, match result, score, standings, awards, and historical participation. Contact and other nonpublic information will be handled as described in the Privacy Policy.
Publicity photographs, video, testimonials, or promotional use of my likeness require separate optional permission. Declining that permission will not prevent ordinary league participation, although incidental appearance in crowd or event photographs may not always be avoidable.
8. No warranties; independent facilities
Activities may occur at facilities AlphaOpen does not own, operate, inspect, or control. AlphaOpen does not warrant the condition, availability, accessibility, lighting, security, staffing, or fitness of a facility. Schedules, rosters, rankings, results, and website information may contain errors or change without notice. To the fullest extent permitted by law, the Activities and website are provided “as is” and “as available,” without warranties of any kind.
Facility owners and personnel, vendors, spectators, other players, drivers, and social-event hosts are independent third parties and are not AlphaOpen employees or agents merely because they assist with or are present at an Activity. AlphaOpen does not assume custody of personal property and is not a bailee for items brought to an Activity.
9. Rules, discipline, and disputes
I will first submit league-administration disputes through AlphaOpen’s published rules and Executive Committee procedures. This does not prevent anyone from seeking emergency assistance, reporting unlawful conduct, cooperating with authorities, or exercising a right that cannot legally be limited.
10. Electronic agreement and duration
By checking the required acceptance box, entering my name, and submitting my registration or season participation request, I intend to sign this Agreement electronically. I confirm that I had an opportunity to read, save, and print it and to ask questions before agreeing.
This Agreement applies to Activities occurring after acceptance and remains effective until replaced. AlphaOpen may require renewed acceptance each season or after a material change. A new version does not retroactively alter the agreement applicable to an earlier Activity.
11. Governing law, severability, and entire agreement
This Agreement is governed by Georgia law. Any permitted court proceeding relating to this Agreement or an Activity must be brought in a court of competent jurisdiction in Fulton County, Georgia, unless applicable law requires otherwise.
If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. This Agreement, incorporated league rules, and any separate written agreement identified at registration constitute the entire agreement on the subjects addressed here.
12. Participant acknowledgment
I acknowledge that I have read and understand this Agreement. I understand the risks of participation and that I am releasing certain claims, including claims based on ordinary negligence to the fullest extent permitted by law. I enter this Agreement knowingly and voluntarily.
